As operações digitais já são realidade em grande parte das nossas empresas, e no início do corrente mês são impositivas, ao menos para os fundos administrados pela SOCOPA.
Dentre as dificuldades, a assinatura do cônjuge ou autorização deste para a concessão do aval ou da responsabilidade solidária fica um pouco mais complicada, ainda mais em face a necessidade de uso da certificação digital.
Para simplificar o fluxo, é possível o uso de procuração (pública ou privada), onde o procurador recebe poderes para assinar em nome do outorgante o aval e responsabilidade solidária, usando o seu próprio e-CPF ou o e-CPF do outorgante.
Por economia, o mesmo modelo pode ser usado para outorgar poderes ou para simplesmente autorizar a assinatura como avalista/responsável solidário.
Sugerimos que a procuração seja específica para operar com a nossa empresa, e contenha expressamente a cláusula de revogação condicionada, ou seja, para os fins das operações, somente terá validade a revogação após a notificação da fomento/securitizadora ou fundo.
Esta procuração é encaminhada para a Administradora, sendo cadastrada duas vezes a assinatura certificada.
